Estate Planning

What Is an Estate Plan?

An “estate plan” is a comprehensive plan governing your assets and personal decision-making both during your lifetime and upon your death. An estate plan often includes beneficiary designations, titling of accounts, deeds, and other documents containing your instructions about what decisions you want your chosen agents to make for you if you pass away or if you are no longer able to make decisions for yourself. The purpose of estate planning is to help you craft plans that reflect your goals and values and that will best answer your “what-if” questions about the future, such as:

  • “What will happen if I cannot manage my own money or health care?”
  • “When I pass away, what will happen to my assets (my property, money, and/or belongings)?”

Don’t waste precious moments worrying about these issues on your own -- let our attorneys provide you with the guidance and advice you need for peace of mind.

Why Do I Need an Estate Plan?

Having an estate plan is necessary for every adult, no matter your age and regardless of how much money or property you have. Estate planning is essential if one of your goals is to avoid guardianship and/or conservatorship and other legal hassles. Estate planning isn’t just for elders either – estate planning helps young families plan for a guardian for their children, and keep the negative impacts of tragedy or emergency to a minimum. When you complete your estate plan with an experienced attorney to guide you, you gain peace of mind, freeing you to enjoy your life.

By making an estate plan, you are providing instructions so your agents—your loved ones or chosen advocates—will be empowered to make decisions about your medical care, your finances, or your assets (your “estate”) that will honor your wishes. People with disabilities should execute plans to preserve their independence and prevent the need for guardianship and conservatorship in the future.

An estate plan typically includes:
  • A health care directive for medical matters
  • A power-of-attorney for financial matters
  • A will or trust for handling property in the manner best suited to your needs and goals.
